Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Generative AI Teknoloji Anonim Sirketi ("AdCreate," "we," "us," or "our"), governing your access to and use of the adcreate.com website and all related services, applications, and tools (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility
You must be at least 16 years old to use AdCreate. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@adcreate.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree to use AdCreate only for lawful purposes and in compliance with all applicable laws and regulations. You may not:
- Generate content that is illegal, defamatory, obscene, harmful, threatening, or that promotes violence or discrimination
- Create deepfake content that impersonates real individuals without their explicit consent
- Use the Service to produce misleading political advertising or disinformation
- Upload content that infringes on the intellectual property rights of others
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Use automated tools (bots, scrapers) to access the Service without our written permission
- Resell, sublicense, or redistribute access to the Service or AI-generated outputs as a competing service
- Circumvent usage limits, credit systems, or security measures
- Transmit viruses, malware, or any code designed to harm the Service or its users
We reserve the right to remove any content that violates these rules and to suspend or terminate accounts engaged in prohibited activity.
AI-Generated Content Ownership
Subject to your compliance with these Terms and your active subscription, you retain ownership of the original content you upload to AdCreate (images, videos, text, brand assets). For AI-generated outputs created through the Service:
- You receive a worldwide, non-exclusive, perpetual license to use, modify, distribute, and commercialize AI-generated content for your business purposes
- AdCreate does not claim ownership of your AI-generated outputs
- AI-generated content is produced using third-party models (Google Veo, OpenAI Sora, HeyGen, and others) and may be subject to their respective usage policies
- You are solely responsible for ensuring your use of AI-generated content complies with applicable laws, including intellectual property, advertising standards, and platform-specific rules
- We do not guarantee that AI-generated content is free from resemblance to existing copyrighted material; you should review outputs before publication
We may use anonymized, aggregated data about how the Service is used to improve our platform, but we will not use your specific content or brand assets for these purposes without your consent.
Subscriptions and Billing
AdCreate offers subscription plans with credit-based usage. By subscribing, you agree to the following:
- Subscription fees are billed in advance on a monthly or annual basis depending on your chosen plan
- All fees are quoted in US dollars (USD) and are non-refundable except where required by law
- Credits included in your plan expire at the end of each billing cycle and do not roll over unless otherwise stated in your plan details
- Subscriptions renew automatically at the end of each billing period; you can cancel at any time from your account settings
- If you cancel, you retain access to the Service until the end of your current billing period
- We reserve the right to modify pricing with at least 30 days advance notice; continued use after a price change constitutes acceptance
- Failed payments may result in temporary suspension of your account until payment is resolved
Payments are securely processed by Stripe. We do not store your full payment card details. Please refer to Stripe's Privacy Policy for information about how they handle your payment data.
Free Tier and Trials
AdCreate may offer a free tier or trial period with limited credits. Free accounts are subject to the same Terms of Service. We reserve the right to modify or discontinue free offerings at any time. Abuse of free tiers (such as creating multiple accounts) may result in account termination.
Intellectual Property
The AdCreate Service, including its design, code, branding, documentation, and proprietary technology, is owned by Generative AI Teknoloji Anonim Sirketi and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the Service itself. The "AdCreate" name, logo, and associated trademarks are our exclusive property.
Third-Party Services
AdCreate integrates with third-party AI providers and services, including Google DeepMind (Veo), OpenAI (Sora), and HeyGen. Your use of features powered by these providers may be subject to their respective terms of service and usage policies. We are not responsible for the availability, accuracy, or policies of third-party services.
Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
- We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
- We do not guarantee the accuracy, quality, or suitability of AI-generated content for any specific purpose
- In no event shall AdCreate, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to AdCreate in the twelve (12) months preceding the claim
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. In such cases, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless AdCreate and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you create, upload, or distribute through the Service.
Termination
You may close your account at any time through your account settings or by contacting hello@adcreate.com. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. Sections related to intellectual property, limitation of liability, indemnification, and governing law survive termination.
Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Istanbul, Turkey. If you are a consumer in the European Union, you may also have the right to bring proceedings in your country of residence.
Modifications to These Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and may notify you via email or an in-app notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you disagree with any changes, you should stop using the Service and close your account.
Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
